RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
I, the undersigned patron (“Patron”) of the Sonterra Municipal Utility District (“Sonterra MUD”) recreational facilities, which include, without limitation, the clubhouses, pools, amenity centers, splash pads, trails, parks, bicycle tracks, and associated facilities and grounds (the “Facilities”), voluntarily agree to the terms and conditions of this “Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement” (this “Agreement”) on behalf of myself and any minors for whom I am legal guardian or otherwise responsible, whose names I have written at the bottom of this Agreement.
ASSUMPTION OF RISK
I understand, acknowledge, and voluntarily assume the risk that I may suffer personal injury, illness, permanent disability, or death as a direct or indirect result of my use of the Facilities or participation in an activity or program hosted by Sonterra MUD. I acknowledge that such personal injury, illness, permanent disability, or death may result directly or indirectly, partially or wholly, from the actions, omissions, negligence, or gross negligence of Sonterra MUD, or its employees, staff, volunteers, officers, agents, and representatives, myself, or other patrons, or may result from the condition of the Facilities. I understand that while reasonable procedures are implemented by Sonterra MUD to mitigate such risks, these risks may still exist due to unforeseen circumstances or accidental events. I have made Sonterra MUD aware of any medical or physical conditions that I have that may increase my risk of personal injury, illness, permanent disability, or death. I HEREBY FULLY ASSUME ALL RISKS MENTIONED IN THIS PARAGRAPH AND ANY RISKS NORMALLY INCIDENTAL TO USE OF THE FACILITIES OR NATURE OF THE ACTIVITY OR PROGRAM, INCLUDING THOSE WHICH ARE NOT FORESEEABLE.
RELEASE OF LIABILITY AND INDEMNITY
Having acknowledged and assumed the risks stated in the above paragraph entitled “Assumption of Risk”, I HEREBY UNCONDITIONALLY RELEASE AND HOLD HARMLESS, AND AGREE TO INDEMNIFY AND DEFEND SONTERRA MUD, AND ITS EMPLOYEES, STAFF, VOLUNTEERS, OFFICERS, AGENTS, AND REPRESENTATIVES FOR ANY AND ALL LIABILITY, INCLUDING PERSONAL INJURY (INCLUDING DEATH), PROPERTY LOSS, CLAIMS, ACTIONS, DAMAGES, COSTS, EXPENSES, AND ATTORNEYS’ FEES THAT MAY ARISE DIRECTLY OR INDIRECTLY FROM MY USE OF THE FACILITIES OR PARTICIPATION IN AN ACTIVITY OR PROGRAM HOSTED BY SONTERRA MUD. I UNDERSTAND AND AGREE THAT THIS RELEASE INCLUDES ANY LIABILITY THAT RESULTS FROM THE ACTIONS, OMISSIONS, NEGLIGENCE, OR GROSS NEGLIGENCE OF SONTERRA MUD, OR ITS EMPLOYEES, STAFF, VOLUNTEERS, OFFICERS, AGENTS, AND REPRESENTATIVES, MYSELF, OR OTHER PATRONS, AND THE CONDITION OF THE FACILITIES, WHETHER OR NOT PARTIALLY OR WHOLLY, OR DIRECTLY OR INDIRECTLY CAUSED BY THEM OR THE CONDITION OF THE FACILITIES.
WAIVER OF CLAIMS
Having agreed to the release of liability and indemnification written in the above paragraph entitled “Release of Liability and Indemnity”, I HEREBY AGREE THAT I WILL NOT BRING A LAWSUIT OR ANY CLAIM IN LAW OR EQUITY AGAINST SONTERRA MUD, OR ITS EMPLOYEES, STAFF, VOLUNTEERS, OFFICERS, AGENTS, AND REPRESENTATIVES FOR ANY AND ALL LIABILITY, INCLUDING PERSONAL INJURY (INCLUDING DEATH), PROPERTY LOSS, CLAIMS, ACTIONS, DAMAGES, COSTS, EXPENSES, AND ATTORNEYS’ FEES THAT MAY ARISE FROM MY USE OF THE FACILITIES OR PARTICIPATION IN AN ACTIVITY OR PROGRAM HOSTED BY SONTERRA MUD. I UNDERSTAND AND AGREE THAT THIS WAIVER OF CLAIMS INCLUDES ANY LIABILITY THAT RESULTS FROM THE ACTIONS, OMISSIONS, NEGLIGENCE, OR GROSS NEGLIGENCE OF SONTERRA MUD, AND ITS EMPLOYEES, STAFF, VOLUNTEERS, OFFICERS, AGENTS, AND REPRESENTATIVES, MYSELF, OR OTHER PATRONS, AND THE CONDITION OF THE FACILITIES, WHETHER OR NOT PARTIALLY OR WHOLLY, OR DIRECTLY OR INDIRECTLY CAUSED BY THEM OR THE CONDITION OF THE FACILITIES.
Having read and understood this Agreement in full, I voluntarily agree to all of its terms and conditions on behalf of myself and any minors for whom I am legal guardian or otherwise responsible, whose names I have written below.

Community Club House Rental Agreement
Responsible Party’s name: Address: Phone #: Email address: Rental Fees: 12 PM - 4 PM: $1255 PM - 9 PM: $12512 PM - 9 PM: $250 Date of Event: In addition to the Rental Fee, there is a $100 deposit for a half day rental and a $250 deposit for a full day rental. This is refundable upon inspection after your event. A check request will be sent to the MUD and can take up to 60 days to process. By initialing, I understand the processing time. Check will be made out and sent to name and address on this agreement. I understand the Sonterra MUD Clubhouse is a non-smoking facility. Smoking in the facility will result in forfeiture of deposit. Facility is to be cleaned after my event and “rental ready” for the following reservation. See cleaning checklist for details (attached). By initialing, I understand and have read the cleaning policy. I understand the use of tacks, sticky tape, confetti and glitter are prohibited. Please discuss with clubhouse manager other means of hanging decorations. I understand beverages in glass bottles are prohibited in the clubhouse and parking lot. I understand the recycle bins are for recyclable items only. Any trash put in the recycle bin will result in forfeiture of deposit. I understand I am responsible for all damages, complaints and/or injury that may occur during my rental time. All vehicles will use the designated parking lot for my event. By initialing, I understand I am responsible for making sure vehicles are not parked or driving on any grassy area at clubhouse. Vehicles may be towed and fees incurred are responsibility of the owner. In the event of a cancellation, the $100 deposit is non-refundable.
Cleaning Expectations
Trash: All trash (including restrooms) must be taken out to the blue trash canisters on side of building. Replace can liners. Do not put trash in green recycle canisters.
Floors: Sweep & mop all tile floors. Vacuum/clean carpets if they were used. Mop water to be dumped outside.
Kitchen: Stove, refrigerator, counters, sink all wiped clean.
Restrooms: Trash removed & liners replaced. Sweep & mop floors & clean toilets.
Front patio: Sweep, free of any trash or food. Pick up trash around lawn area.
Decorations: Absolutely do not use tacks, glue or tape on the walls, countertops, or fans. Please consider other options for décor if you need backdrops or photo props. Do not use glitter or confetti. Use of the above items is automatic forfeiture of deposit.
Pre Cheklist: The renter is responsible for checking over the facility before and after the rental. Please make note of anything that is wrong with the facility and notify the coordinator the day of. Carpets: Floors: Restrooms: Kitchen: Supplies: Walls: Other:
Post-Cleaning Checklist: All cleaning supplies are under the sink in the kitchen. Mop and bucket are located in the supply closet. Extra trash bags, paper towels, & soap are under sink as well.
